In this case, our client was a Chinese national who had previously studied in the UK under a Tier 4 (Student) Visa but had since returned to China for a year.
During their time in the UK our client had formed a relationship with a British citizen and continued this relationship remotely from China.
Our client returned to the UK on another Tier 4 (Student) Visa, and during this time, got engaged and married their long-term partner. Our client then approached us with the intention of switching to a UK Spouse Visa.

What is UK Spouse Visa

Under the UK’s immigration rules, a non-EU foreign spouse of a British citizen must satisfy 3 general sets of requirements in order to obtain a Spouse Visa. The first is a relationship requirement, whereby an applicant must show that they are in a genuine and subsisting relationship with a British Citizen or a person settled in the UK; the second is an English language requirement, where an applicant must demonstrate that they have a sufficient knowledge of English; and finally, there is a financial requirement which specifies that an applicant must have sufficient income to avoid being reliant on public funds in the UK.

Drawing from their extensive experience in preparing and submitting these kinds of applications, our solicitors were able to assist our client to obtain relevant evidence of their relationship together and the applicant’s knowledge of English. Additionally, our solicitors were able to assist our client to obtain the highly specific documentation required to evidence that our client and their partner met the financial requirement. In this instance, this involved a combination of salaried income from multiple jobs in conjunction with cash savings.

The outcome

The Spouse Visa application was successful, and our client was granted their visa so that they can live their life with their loved one in the UK.
